By downloading, installing, or using Photo Loco ("the app") or visiting photoloco.app ("the website"), you agree to be bound by these Terms of Service. If you do not agree, do not use Photo Loco.

In these terms, "the platform" means the Photo Loco app and the photoloco.app website together. Content displayed on the website is treated the same way as content displayed in the app.
Photo Loco is a community platform for discovering and sharing photography locations. You may use the app for personal, non-commercial purposes in accordance with these terms.
You must be at least 13 years old to create an account. By creating an account you confirm you meet this requirement.
You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account.
You may not create accounts using automated means, use another person's account without permission, or create an account if you have previously been removed from the platform.
When you submit a location, photo, description, or any other content to Photo Loco, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content within the Photo Loco platform, and for the limited promotional purposes described in Promotional Use of Your Photos below. This licence exists so we can run and promote the app — it does not transfer ownership, and it does not allow us to sell your work or license it to anyone else.
What happens to this licence if you delete your account
If you delete your account, what happens depends on the content:
For content that stays on Photo Loco after you delete your account, the licence above continues on the same terms, for as long as that content remains on the platform. It stays limited to running the app: it still does not transfer ownership, and it still does not allow us to sell your work or license it to anyone else. The separate promotional licence described in Promotional Use of Your Photos ends when you delete, whichever choice you make about photos.
Deletion is immediate and cannot be undone. There is no grace period and no way to recover an account once it is deleted.
You retain ownership of content you submit. You confirm that content you submit:
We reserve the right to remove any content that violates these terms or our community standards.
Photo Loco is built on the work of the photographers who use it, and showing that work is how the app grows. This section sets out exactly what we may do with your images, and what we will never do without asking you first.
What we may do without asking
We may feature photos and locations you have submitted as public in Photo Loco's own marketing materials, including:

Minor cropping, resizing, or overlaying app UI is permitted where it is needed to fit a format such as a story, banner, or store screenshot.
What we will never do without your prior written consent
If we want to do any of the above, we will contact you first and agree terms — including any fee — separately. You are free to say no, and saying no will not affect your account, your Pro subscription, or how your locations appear in the app.
Put simply: we may show your public photos to promote Photo Loco itself, always credited. We will not make money from your photos, or attach them to anyone else's brand, without asking you first.
Content submitted before these terms
This section applies to all public content on Photo Loco, including content submitted before this version of the terms took effect. If you submitted content under earlier terms and are not happy with this change, you can opt out below or delete the content, and we will honour that without argument.
Opting out
You can opt out of promotional use at any time, for all of your content or for a specific image, by emailing hello@photoloco.app from the address on your account. You do not need to give a reason, and we will not ask you to justify it. We will stop using the content in new marketing straight away, and remove it from materials we control within 30 days.
Some things take longer or are outside our control, and you accept this as a practical limit: App Store and Google Play listings can only be changed at the next app release or store review cycle; already-published social posts, third-party press coverage, screenshots taken by others, and copies cached or reshared by third parties may remain in circulation. We will make reasonable efforts to have material we control taken down.
Deleting content or your account
Deleting a photo or your account ends the promotional licence in this section for any future use. It does not retroactively affect marketing material already published, subject to the same removal efforts described above.
This is separate from the platform licence in Content You Submit, which continues for public locations, contributions, and any photos you chose to leave in place after deletion. In short: we stop using your work to promote Photo Loco, and anything you left on the platform stays there without your name on it.
No payment
Promotional use under this section is unpaid, and you are not entitled to any fee, royalty, or compensation for it. Any paid arrangement would be agreed with you separately in writing.
Your responsibility
By submitting a photo you confirm you took it, or otherwise hold the rights to it, and that you have any permission needed from people, property owners, or vehicle owners shown in it. If a photo you submitted turns out not to be yours to grant, tell us immediately and we will remove it.

Photo Loco offers an optional Pro subscription that unlocks additional features including unlimited saved locations, unlimited private spots, and advanced tag filtering.
Subscription options
Prices shown are for the United Kingdom. Prices in other countries and regions are set in local currency and may differ. The price that applies to you is the one shown in the app and confirmed by the App Store or Google Play at the point of purchase.
Billing and auto-renewal
Subscriptions are billed through the Apple App Store or Google Play Store depending on the platform you use. Payment is charged to your store account upon confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
Price changes
We may change subscription prices from time to time. Any change applies from your next billing period onwards and never retroactively to a period you have already paid for.
If a price increases, we will give you at least 30 days' notice before the new price takes effect. That notice will tell you which subscription is affected, its current price, the new price, the date the new price applies from, and how to cancel. Depending on your store and region you may be asked to accept the new price before it takes effect; if you do not accept it, or you cancel before that date, your subscription will end at the close of your current billing period instead of renewing at the higher price.
If a price decreases, the lower price will normally take effect at your next renewal without you needing to do anything.
Cancellation
You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. You will retain Pro access until that date. No refunds are issued for unused portions of a billing period.
Downgrade
Upon cancellation, your account reverts to the free tier. Saved locations exceeding the free tier limit will become inaccessible but will not be deleted.
By subscribing through the App Store, you also agree to Apple's Standard End User Licence Agreement (EULA): apple.com/legal/internet-services/itunes/dev/stdeula
Locations shared on Photo Loco are user-submitted. We do not verify the accuracy, safety, or legality of accessing any location. You are solely responsible for your own safety when visiting any location found through Photo Loco.
Always respect private property, local laws, and road safety regulations. Photo Loco accepts no liability for any injury, loss, or legal consequence arising from visiting a location discovered through the app.
The Photo Loco name, logo, design, and codebase are the property of Christian Williams. You may not reproduce, distribute, or create derivative works from Photo Loco's branding or interface without written permission.
Photo Loco is provided "as is" without warranties of any kind. We do not guarantee that the app will be available at all times, error-free, or that location information will be accurate or up to date.
To the maximum extent permitted by law, Christian Williams shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Photo Loco, including but not limited to loss of data, personal injury, or property damage.
We reserve the right to suspend or terminate your account at any time if you violate these terms. You may delete your account at any time via the app settings or by contacting us.
Your use of Photo Loco is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these terms from time to time. Continued use of Photo Loco after changes are posted constitutes acceptance of the updated terms. We will notify users of significant changes via the app or email.
